CATE YOUNG DESIGN PTY LTD – BLUEPRINT COURSE AGREEMENT
During the Design The Life You Love, Blueprint™ Foundation Course (the Course), you will be guided through potent processes that will help you tap into your Blueprint™ and design a life that’s in alignment with your unique purpose.
Please read the following terms and conditions, if anything is unclear, please ask. By participating in the Course you (the person named at the end of this document and referred to as the “you” or “Client”) are agreeing to be bound by the Terms of this Agreement between you and Cate Young Design Pty Ltd ACN 101 440 840. The Course will be administered by Cate Young, Life Stylist & Integrative Health Coach (the “I” or “Coach”).
The Course in which you have enrolled in will include any or all of the following:
a) Introductory discussion about the Course
b) Meditation and envisioning processes designed to help your team tap into their full potential and unique purpose
c) Creation of vision boards
d) Recommendations, handouts, and other materials
e) Participating in group discussions as desired
TERMS AND CONDITIONS:
SCHEDULING
During the Design The Life You Love, Blueprint™ Foundation Course, you’ll experience and learn potent processes and tools that will keep you accountable for putting the fire back into your life. You’ll be guided through mindfulness practices and creative methods grounded in modern psychology, science and ancient wisdom designed to help you realign with your purpose, connect with what truly matters to you and design a life you truly love.
You will come away feeling aligned and inspired with a clear vision for your life, and importantly, an action plan and the tools to bring it to life.
YOU WILL GAIN:

This Course will run for 4 weeks, and will be held in The Heart Centre at Amara Retreat, in Verrierdale every Tuesday in August from 12-2pm. The Course will commence on Tuesday, August 4 and complete on Tuesday, August 25 making the total course hours 8. I understand that my clients have busy schedules and I take pride in being on time and request that you arrive at least 15 minutes prior to the start time.
If the client is unable to attend one of the Course days, the Client is requested to give the Coach a minimum of 24 hours notice and the Coach will endeavour to run through the contents of the course day at another suitable time.
PAYMENTS AND REFUNDS
The Client understands that the cost of the Workshop is $...... and is to be paid in full prior to the scheduled date of the Course. (unless a payment plan has been agreed). In the event of the Client’s absence or withdrawal, for any reason whatsoever, the Client will remain responsible for 50% of the Course fee, plus a cancelation fee of $50.
The Client acknowledges that the Coach may cancel the Course or any portion of it and at any point where the Coach considers that it is unviable, impractical or otherwise commercially disadvantageous for the Course to continue. Where the Coach terminates the Course in such circumstances, the Client will only be responsible for the pro rata share of the Course that has been delivered.
Neither the Coach or Cate Young Design Pty Ltd will be liable for any loss or damage, of whatsoever nature and howsoever arising, that is suffered or incurred as a result of cancelling a Course for the reasons contemplated in the above paragraph.
DISCLAIMERS
The Client understands that the role of the Coach is not to assess wellbeing; provide health care, medical or nutrition therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who has been trained in holistic health coaching to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes.
The Client understands that the Coach is not acting in the capacity of a doctor, licensed dietician-nutritionist, psychologist or other licensed or registered professional, and that any information given by the Coach is not to be construed as advice and must not be taken as a substitute for the advice of duly qualified health care and medical professionals.
If the Client is under the care of a health care or medical professional or currently uses prescription medications, the Client should discuss any changes to their current health regime, dietary changes or potential dietary supplements use with his or her health care or medical professional and should not discontinue any prescription medications or other treatments prescribed by a health care or other medical professional without first consulting his or her health care professional.
The Client has chosen to work with the Coach and understands that the information received should not be seen as medical or prescriptive advice and is not meant to take the place of seeing licensed health and medical professionals.
PERSONAL RESPONSIBILITY AND RELEASE OF HEALTH CARE RELATED CLAIMS
The Client acknowledges and takes full responsibility for their life and well-being, as well as the lives and well-being of their families (where applicable) and all decisions made during and after this Course.
The Client expressly assumes the risks of the Course, including the risks of taking part in new processes, and the risks inherent in making lifestyle changes. The Client releases the Coach and Cate Young Design Pty Ltd from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client’s
past or future participation in, or otherwise with respect to, the Course, unless arising from the gross negligence of the Coach.
CONFIDENTIALITY, RESTRAINT AND INTELLECTUAL PROPERTY RIGHTS
Confidential Information
For the purposes of this clause Confidential Information means all information and material (of whatever nature and medium of communication) which is communicated to, available to, or accessible by you in connection with the provision of the services of the Coach throughout the duration of the Course, which is not information that is in the public domain (other than through a breach of this Agreement).
For the avoidance of doubt, Confidential information includes course content and materials provided by the Coach and the teaching methodologies, styles and concepts associated with the Blueprint ™ Course delivered by the Coach.
The Client must keep all Confidential Information confidential and only use Confidential Information for the purposes of participating in the Course.
The obligations to maintain the secrecy of the Confidential Information will not apply where the Client is required to make disclosure to comply with the law; to any disclosure agreed in writing between the parties; or in respect of any portion of the Confidential Information which has entered the public domain other than as a result of a breach of this Agreement.
Restraint
The Client acknowledges that the Blueprint™ Course is a proprietary method developed and owned by Cate Young Design Pty Ltd and delivered by the Coach.
The Client acknowledges that the unauthorised reproduction of any of the teaching methods, teaching concepts or content delivered as part of the Course will result in substantial damage being sustained by Cate Young Design Pty Ltd and the Coach.
The Client acknowledges and agrees that they will not at any time during or after the expiration or termination of this Agreement:
(a) reproduce any methodology or teaching content; or
(b) share any teaching method, concept or content to a third party, that was delivered to the Client as part of the Blueprint ™ Course.
Intellectual Property Rights
Intellectual Property Rights means all intellectual and industrial property rights and interests throughout the world,
whether registered or unregistered, including trade marks, designs, patents, inventions, circuit layouts, copyright
and analogous rights, confidential information, know how and all other intellectual property rights as defined in
Article 2 of the convention establishing the World Intellectual Property Organisation of 14 July 1967 as amended
from time to time.
The Client acknowledges that all Intellectual Property Rights subsisting in any content or materials provided to the
Client during and after the Course are owned or used under licence by Cate Young Design Pty Ltd and the
Coach. The Client must not in any way reproduce any Intellectual Property Rights owned by Cate Young Design
Pty Ltd or the Coach without expressed written consent.
Use of any material or content in which Intellectual Property Rights subsist is limited to this Course only. Any use
outside of this scope will be negotiated separately between the parties.
Indemnity and Liability
You agree to indemnify Cate Young Design Pty Ltd and the Coach and to keep them indemnified against any damage, cost, loss, liability or expense of any kind and however arising, that may be suffered or incurred by Cate Young Design Pty Ltd or the Coach, arising from or in connection with (directly or indirectly): any breach or default by you, of this Agreement (including any breach of warranty); a negligent act or omission by you; or your failure to comply with any Law.
Except as expressly provided by this Agreement, the Course is provided on an “as is” basis without any representation, warranty or guarantee as to quality, condition or fitness for purpose. Neither Cate Young Design Pty Ltd or the Coach warrants that the Course will be free of defect, uninterrupted, accurate, complete, current, stable, error free or available at any time.
Except in relation to liability for personal injury (including sickness and death), property damage or an infringement of confidentiality or Intellectual Property Rights, the liability of Cate Young Design Pty Ltd and the Coach in damages (including special, indirect or consequential damages, which damages will be deemed to include loss or revenue, loss or profit and opportunity loss) in respect of any act or omission in connection with their obligations under this Agreement, will not exceed the net payment received from you in the immediately preceding 6 months from when the cause of action arose.
To the maximum extent permitted by law, Cate Young Design Pty Ltd and the Coach will not be liable for any ordinary, incidental, consequential or special loss or damage (including but not limited to loss of profits and loss of data) arising out of this Agreement or your participation in the Course even if we were appraised of the likelihood of such loss occurring.
Any condition, guarantee or warranty which would otherwise be implied in this Agreement is hereby excluded, except for liability for breach of a guarantee conferred by the Australian Consumer Law (other than those conferred by ss 51 to 53 of the Australian Consumer Law), in which case that breach is limited (at our election) to providing the Course again or the payment of the cost of having the Course provided again.
Disputes
If a dispute arises out of or relates to this Agreement (Dispute) a party to the Agreement may not commence any court or arbitration proceedings relating to the Dispute unless it has complied with this clause, except where the party seeks urgent interlocutory relief.
A party claiming that a Dispute has arisen must give a Notice (Dispute Notice) to the other party or parties to this Agreement specifying the nature of the Dispute. The parties must then negotiate in good faith to resolve the Dispute expeditiously using informal dispute resolution techniques such as mediation, expert evaluation or determination or similar techniques agreed to by them.
If the parties do not resolve the Dispute within fourteen (14) days of receipt of the Dispute Notice (or such further period as agreed in writing by them) any party to the Dispute may refer the Dispute to mediation by a mediator nominated by the President or the nominee of the President for the time being of the Queensland Law Society Incorporated.
Each party must bear its own costs in connection with resolving the Dispute and the parties must bear equally the costs of any mediator engaged.
Any information or documents disclosed by a party under this clause must be kept confidential and may not be used except to attempt to resolve the dispute.
Execution
This Agreement is governed by and is to be construed in accordance with the laws in place in Queensland, Australia. The parties both submit to the non-exclusive jurisdiction of the Courts of Queensland, Australia.
